EL SALARIO MÍNIMO. SU MONTO VIOLA LA CONSTITUCIÓN Y ES FACTOR DE
EMPOBRECIMIENTO. Y EN ESPECIAL A LAS MUJERES QUE SON LAS MÁS
POBRES.

ABSTRAC
The minimum wage arises as a fundamental part in the right of all Mexicans to decent
and socially useful work, said salary being the minimum amount for the performance
of such work. It arises with the purpose of providing a constitutional guarantee of a
minimum of well-being for all salaried persons and their families.
However. The current amount of the general minimum wage is in violation of
constitutional terms and is a factor of impoverishment. Well, $ 102.68 (one hundred
two pesos and sixty-eight cents), is not enough to meet the normal needs of a
householder, in the material, social and cultural order, and to provide for the
compulsory education of the children. As provided by our supreme law. Even more
serious for working women who are mothers, heads of household and some
discriminated against.
The current general minimum wage is still insufficient with everything and the
significant and significant increase of 16% and 100%, respectively, for the rest of the
country and for the free zone of the northern border, effective as of January 1, 2019
The effort of promotion and agreement of such increases made by the President of
the Republic is commendable but insufficient. We must continue the effort.
In accordance with the constitutional terms, we should consider the official INEGI data
related to the constitution of Mexican households for an average of 3.7 people in each
of them.
It is urgent, and very important to raise the amount of the general minimum wage in
order to guarantee sufficient income to meet the needs of the welfare line for workers
in Mexico and their families.
That is, if the monthly value per person of the income poverty line or welfare line, which
includes food basket plus non-food, as of October 2019, is $ 3,111.36; and,
considering the average of 3.7 people living by household in Mexico, we find a
minimum monthly income amount to cover the basic of welfare in the order of $
11,512.03 and therefore $ 383.73 per day as a general minimum wage.
We must not allow ourselves to be complacent to the poverty of those who work.
We must not allow ourselves to be indifferent to the breach of our Supreme Law.

RESUMEN
El salario mínimo surge como parte fundamental en el derecho de todos los
mexicanos a un trabajo digno y socialmente útil, siendo dicho salario el monto mínimo
por el desempeño de tal trabajo. Surge con la finalidad de brindar una garantía a nivel
constitucional de un mínimo de bienestar para todas las personas asalariadas y sus
familias.
No obstante. El monto actual del salario mínimo general es violatorio de los términos
constitucionales y es un factor de empobrecimiento. Pues, $102.68 (ciento dos pesos
con sesenta y ocho centavos), no es el monto suficiente para satisfacer las
necesidades normales de un jefe de familia, en el orden material, social y cultural, y
para proveer a la educación obligatoria de los hijos. Tal como lo dispone nuestra ley
suprema. Más grave aún para las mujeres trabajadoras que son madres, jefas de
familia y algunas discriminadas.
El salario mínimo general actual aún es insuficiente con todo y el notable e importante
incremento del 16% y del 100%, respectivamente, para el resto del país y para la zona
libre de la frontera norte, vigente a partir del 1º de enero del 2019. El esfuerzo de
promoción y acuerdo de tales incrementos hecho por el Presidente de la República
es encomiable pero insuficiente. Hay que continuar con el esfuerzo.
En congruencia con los términos constitucionales deberíamos considerar los datos
oficiales del INEGI relativos a la constitución de los hogares de México por un
promedio de 3.7 personas en cada uno de ellos.
Es urgente, y de suma importancia elevar el monto del salario mínimo general a efecto
de garantizar el ingreso suficiente para cubrir las necesidades de la línea de bienestar
para los trabajadores de México y sus familias.
Esto es, si el valor mensual por persona de la línea de pobreza por ingresos ó línea
de bienestar, que incluye canasta alimentaria más no alimentaria, al mes de octubre
del año 2019, es de un monto de $ 3,111.36; y, considerando el promedio de 3.7
personas viviendo por hogar en México, nos resulta una cantidad de ingreso mensual
mínimo para cubrir los básicos del bienestar por el orden de $11,512.03 y por
consiguiente de $383.73 por día como salario mínimo general.
No debemos permitirnos ser complacientes ante la pobreza de quien trabaja.
No debemos permitirnos ser indiferentes ante el incumplimiento de nuestra Ley
Suprema.
