Que en cumplimiento al párrafo Segundo del artículo 330 de la Ley de Asentamientos Humanos del Estado de Colima, el H. Ayuntamiento ha acordado para su publicación la siguiente:
INCORPORACION MUNICIPAL ANTICIPADA DEL FRACCIONAMIENTO DENOMINADO "IKAL" ETAPA 1
CONSIDERANDO:
PRIMERO.-
Que por instrucciones del C. Presidente Municipal PROFR. FEDERICO RANGEL LOZANO, recibimos memorándum No. S-604/2014, suscrito por el C. Secretario del H. Ayuntamiento, LIC. SALVADOR CARDENAS MORALES, mediante el cual turnó a esta Comisión el Oficio número DGDUEV 492/2014, signado por el Director General de Desarrollo Urbano, Ecología y Vivienda, ARQ. BELARMINO CORDERO GOMEZ, en el que pone a consideración del H. Cabildo, el Dictamen técnico de Incorporación Municipal Anticipada del fraccionamiento que nos ocupa denominado "IKAL " Etapa1 de la ciudad de Colima, Colima.
SEGUNDO.-
Que dicha solicitud cumple con lo estipulado en el artículo 328 de la Ley de Asentamientos Humanos, toda vez que el peticionario, ARQ. JOSE ANGEL LOPEZ VILLEGAS apoderado legal de la empresa "BRACSA CONSTRUCCIONES, S.A. DE C.V. y promotora del Fraccionamiento "IKAL " Etapa1, presentó ante la dependencia municipal, oficio en que solicita la Incorporación Municipal del referido fraccionamiento.
TERCERO.-
Que conforme al Dictamen Técnico que corresponde al oficio No. DGDUEV-492/2014, de fecha 05 de Agosto del presente año 2014, expedido por el ARQ. BELARMINO CORDERO GOMEZ, Director General de Desarrollo Urbano, Ecología y Vivienda del Municipio de Colima, se acredita que el Urbanizador cumple con lo estipulado en el Programas de Desarrollo Urbano de nuestro municipio de Colima".
De lo anterior, se deriva que las áreas previstas a incorporar de la etapa 1 del fraccionamiento "IKAL ", tiene una superficie total de 61,161.40 m 2, conformada de la siguiente manera:
142 lotes de tipo Habitacional Unifamiliar Densidad Alta (H4-U), con superficie de 14,211.89 m 2,
01 lote de tipo Habitacional Plurifamiliar Horizontal Densidad Alta (H4-H), con superficie de 18,042.67 m 2;
01 lote de tipo Mixto de Barrio Intensidad Alta (MB-3), con superficie de 466.76 m 2,
01 lote de tipo Espacios Verdes y Abiertos (EV), con superficie de 612.75 m 2,
01 lote de tipo Equipamiento Institucional (EI), con superficie de 5,752.56 m 2,
02 lotes de tipo Infraestructura (IN), con superficie de 892.38 m 2, y un área de Vialidad de 21,182.39 m 2, en los términos que a continuación se describen:
