Patricio Martínez García, del Grupo Parlamentario del Partido Revolucionario Institucional, con proyecto de decreto por el que se reforma el artículo 115 de la Constitución Política de los Estados Unidos Mexicanos.SE TURNó A LAS COMISIONES UNIDAS DE PUNTOS CONSTITUCIONALES; DE DESARROLLO MUNICIPAL; Y DE ESTUDIOS LEGISLATIVOS, SEGUNDA.Ver Sinopsis Español:Propone modificar el artículo 115 de la Carta Magna para impedir de manera terminante a la administración municipal, enajenar bajo cualquier forma los bienes inmuebles con los que los municipios cuentan, es decir, no transfiere la responsabilidad a los Congresos de los Estados sino que definitivamente fija el criterio de que los bienes inmuebles municipales no pueden ni deben ser objeto de alienación, pues su objetivo es solo para el servicio público y no para financiar o proveer fondos al gasto municipal, por precarias que sean sus fuentes. Por otra parte, abre la posibilidad de que en caso de que el ayuntamiento en funciones otorgue una donación de algún bien inmueble para alguna organización con fin altruista o de beneficio para la población, a través de asociaciones civiles y similares, y aún dependencias y organismos estatales, municipales y federales, esto debe ser solo de uso y goce, no en propiedad y estar condicionada a que cumpla con el objetivo para el cual fue donado y de no ser así, o cuando deje de cumplir este fin, inmediatamente debe revertirse el bien al patrimonio pleno del municipio.Synopsis in English:Proposes to modify article 115 of the Magna Carta to strictly prevent the municipal administration, alienate in any way the real estate with which the municipalities count, that is, does not transfer responsibility to the Congresses of the States but definitely fixes the criterion that municipal real estate can not and should not be object of alienation, since its objective is only for the public service and not to finance or provide funds for municipal spending, however precarious its sources may be. On the other hand, it opens the possibility that in the event that the acting municipality grants a donation of some real estate for an organization with altruistic purpose or benefit for the population, through civil associations and similar, and even dependencies and agencies state, municipal and federal, this must be only for use and enjoyment, not property and be conditioned to meet the purpose for which it was donated and if not, or when it stops fulfilling this purpose, it must immediately be reversed well to the full heritage of the municipality.
