ENVIRONMENTAL JUSTICE: THE CASE OF LA LAGUNA DEL CARPINTERO

RESUMEN: El acceso a la información y el acceso a la justicia son derechos
fundamentales que guardan un vínculo sinérgico, sin embargo pocas veces se
profundiza en dicha relación y sus retos ante la crisis ambiental actual. En este
contexto, la presente investigación tiene como objetivo analizar el papel que juega
el acceso a la información, como elemento neguentrópico para la justicia
ambiental, lo anterior a partir del estudio del amparo en revisión 307/2016 resuelto
por la Suprema Corte de Justicia de la Nación, donde vecinas de la Laguna del
Carpintero, en el municipio de Tampico, Tamaulipas, reclamaron la violación de su
derecho a un medio ambiente sano. Este análisis intenta contribuir con la
búsqueda y construcción de nuevas comprensiones y herramientas que permitan
avanzar en la concreción efectiva del derecho de acceso a la justicia ambiental.

ABSTRACT: Access to information and access to justice are fundamental rights
that maintain a synergistic relationship, however, this relationship and its
challenges are rarely explored in the face of the current environmental crisis. In this
context, the purpose of this investigation is to analyze the role played by access to
information, as a neguentropic element for environmental justice, based on the
study of the Amparo under review 307/2016 resolved by the Supreme Court of
Justice of the Nation, where residents of the Laguna del Carpintero, in the
municipality of Tampico, Tamaulipas, claimed the violation of their right to a healthy
environment. This analysis tries to contribute to the search and construction of new
understandings and tools that allow progress in the effective realization of the right
of access to environmental justice.
