Abstract:
Throughout the years we have been able to observe the worldwide evolu-
tion that has arisen regarding the recognition of Human Rights, among them,
the Right to Political Participation and the Right to Citizen Participation.
The mechanics behind Political Participation have been an essential part
and a critical factor in the laying of a foundation upon which a democracy
has been built, nevertheless, political intervention, which has been inter-
twined with the Law, has in occasions set back the full application of de-
mocracy and the promotion of its culture. On this paper I will focus on
analyzing what a Referendum is, considering the content of the Constitution
(the Political Constitution of the United Mexican States or the “PCUMS”)
and the Federal Law on Referendums. Furthermore, we will dive into what
Legal Doctrine regards as a Referendum. As well, I will focus on the evolu-
tion that this concept has undergone, the requirements and procedures to
conduct a Referendum, on which topics and at what times can they be con-
ducted, if its results are binding or not, how to identify and determine its
constitutionality or lack of it, and who has the legal authority to determine
such matter.
